Welcome to the Posey Circuit Court

Our Mission

The mission of the Posey Circuit Court Probation Department is to provide information ordered by the Court and to accept juveniles and adults who are ordered to probation by the Posey Circuit Court or transferred to the Department and to supervise, record, and report their compliance with the terms of their probation in a manner which meets governing standards, protects the public, assists victims, and provides for the rehabilitation of offenders consistent with the effective application of Department resources.

Who We Are
The Posey Circuit Court Probation Department staff includes a Chief Probation Officer and three deputy probation officers.  All staff members hold BS degrees with one staff member holding an MS degree.  The staff is highly experienced and computer literate.

What We Do
The Posey Circuit Court Probation Department is an arm of the Court.  The Probation Department is not a law enforcement agency, but responds to the work of law enforcement agencies in the following way.

Law enforcement agencies file reports of law violations with the Posey County Prosecutor's Office.  The Posey County Prosecutor investigates the reported incidents and decides whether and how to proceed.

Adults
In adult matters, the Prosecutor may file charges and involve the Court in deciding guilt or innocence and sentencing.  For sentencing the Court may order the Probation Department to prepare a Presentence Report to assist the judge in determining an appropriate sentence.  When sentences involve periods of probation, the Probation Department supervises the probationer to insure that the probationer complies with terms to be observed during the probation period.

Juveniles
In juvenile matters, the Prosecutor may forward the referral to the Probation Department for further inquiry.  The Probation Department produces a Preliminary Inquiry Report which includes a recommended course of action.  Possible recommended courses of action include: (1) Charge Dismissal, (2) Referral to another agency, (3) Informal adjustment, or (4) Formal Charge Filing.

The Prosecutor responds to the Preliminary Inquiry Report by returning a notice of action to the Probation Department.  For Informal Adjustments, the juvenile agrees to terms of probation which the Probation Department supervises.   When formal charges are filed, the Court will decide whether to adjudicate the juvenile.  If the juvenile is adjudicated, the Probation Department will file a Predisposition Report to assist the judge in determining the disposition of the case.   The Probation Department will supervise the juvenile during any period of probation decided by the Court.

Administration and Court Support
The Posey Circuit Court Probation Department has developed and maintains software to prepare:  (1) quarterly and annual probation reports for the Indiana Supreme Court;  (2)  monthly claims including payroll claims for the Posey County Commissioners; and (3) annual budgets for submission to the Posey County Council.

The Posey Circuit Court Probation Department has developed and maintains a jury management system for use by the Posey Circuit Court Bailiff

Court and Probation Systems Development
Staff of the Probation Department are involved in the development of Court systems including the Family Court.  Probation staff members write grant requests and since 1991, have automated extensively both juvenile and adult probation systems.
